The Local is providing this section in hopes of educating and assisting our members with information about Labor Management
Relations. This section will continue to grow, but we believe we have enough to get members educated for disciplinary
actions.
The sections on the "Douglas Factors" and "Seven Tests of Just Cause" should help members to understand more of what
is needed by management to justify disciplinary actions. I encourage members to read these links and refer to them whenever
they are ordered to write a memorandum or vehicle accident report.
Another popular topic these days is Critical Incident Team (CIT) investigations. These are similar to Office of
Internal Audit (OIA) investigations. A link to the OIA handbook on investigations has been provided. Agents are
encouraged to contact Union Representatives whenever facing a CIT team interview. The Local will consider letting
members speak to PORAC legal personnel prior to the interview in order to clarify any issues the members may have.
Additionally, a copy of the Collective Bargaining Manual has been provided for those agents that have lost the copy they
received at the academy. This manual is very easy to read and is not very long. It should help each member to
better understand their rights as employees.
I am trying to get a PDF copy of the CBP Table of Ethics and Conduct. I have not been able to find it on the CBP
website, since they seem to have deleted it. However, I have several paper copies of it and am just waiting to scan
them into PDF format to place on the website for those who have not had a chance to refer to them.
